SCJN Confirms Mexico City Civil Protection Responsibility Model

According to a press release from the Supreme Court of Justice of the Nation (SCJN) No. 113/2026, issued on August 11, 2026, the Plenary of the SCJN has confirmed the constitutionality of various provisions of Mexico City's Risk Management and Civil Protection Law, reformed in 2021.

Implications for Businesses and Property Owners

The SCJN's decision establishes that only natural persons can obtain registration and authorization to act as an "Official Civil Protection Responsible" in Mexico City. This measure aims to ensure that activities affecting people's lives, integrity, and safety are carried out by someone fully identifiable, which represents an objective and reasonable criterion.

It is important to note that this determination does not prevent legal entities (companies) from carrying out activities related to civil protection. However, functions requiring administrative authorization must fall to a duly accredited natural person.
