SCJN Validates Financing Scheme for Public Investments in Guanajuato

According to press release No. 109/2026 from the Supreme Court of Justice of the Nation (SCJN) dated August 04, 2026, the highest court has validated the normative system regulating the obtainment of financing for productive public investments in the state of Guanajuato during the 2026 fiscal year.
The SCJN determined the constitutionality of article 1, section E, of the Guanajuato State Revenue Law and article second of Decree 164. These establish the rules regarding the destination of resources, amounts, payment mechanisms, budgetary guarantees, and accountability for income obtained through authorized financing, linking them to various productive public investment programs.
The Court clarified that article 117, section VIII, of the Political Constitution of the United Mexican States establishes a co-participation model between the Legislative and Executive Powers regarding local public debt. Under this scheme, congresses are responsible for authorizing the general concepts and maximum amounts of financing, following an analysis of their destination and payment capacity, while the Executive is responsible for executing investments and rendering accounts. It was concluded that the Federal Constitution does not require Congress to exhaustively identify each specific work or project to be financed with debt, but rather that it is sufficient to define general categories of productive public investment and set specific amounts for each, as occurred in this case with programs for educational infrastructure, social and sustainable development, regional mobility, agriculture, medical care, and public security.
