SCJN Upholds Dignified Conditions for Field Workers

The Supreme Court of Justice of the Nation (SCJN), in a press release dated August 05, 2026, has issued a key ruling directly impacting employers' obligations in the agricultural sector. The Plenary Court determined the constitutionality of articles 283, fractions II, III, IV, VI, VII, X, XIII, XIV, and 284 of the Federal Labor Law (LFT).

These provisions, now confirmed as constitutional, establish a clear framework of obligations and prohibitions to ensure dignified conditions for field workers. Among employers' responsibilities are providing dignified housing free of charge, offering food and water during working hours, ensuring transportation for medical attention, providing first-aid materials, fostering education, and offering training on equipment use.

Furthermore, prohibitions such as the employment of children and adolescents, the payment of wages with merchandise, and forcing workers to bring their children to the workplace are reiterated. The SCJN emphasized that agricultural employment presents particular conditions justifying reinforced protection, and that the obligation to provide housing does not substitute Infonavit contributions, as they have distinct natures and purposes.
